These Terms of Use govern your access to and use of this website and the content, assessments, and materials offered here. The site is operated by The Hayes Project, 9333 Baseline Rd, Suite 290, Rancho Cucamonga, CA 91730.
1. Acceptance of These Terms
By using the site you agree to these Terms. If you do not agree, do not use the site. If you enroll in a program, the Program Terms also apply and control where they conflict with these Terms.
2. Who May Use This Site
You must be at least eighteen years old and able to form a binding contract. If you use the site on behalf of an organization, you represent that you are authorized to bind that organization.
3. The Services We Provide
We provide educational content, speaking and workshop services, the Find Your Gap™ assessment, and coaching and mentorship programs focused on behavior change and follow-through. These services are professional and educational. They are not therapy, medical care, psychological diagnosis or treatment, legal advice, or a behavior-analytic treatment relationship, and no clinician–client relationship is created by using this site.
4. Accounts and Registration
Some features require an account. Keep your credentials confidential, provide accurate information, and tell us promptly of any unauthorized use. You are responsible for activity under your account.
5. Acceptable Use
Do not misuse the site. You agree not to scrape or bulk-download content, reverse engineer or interfere with the site, upload malware, attempt unauthorized access, harass others, impersonate anyone, submit false information, or use the site in violation of any law.
6. Intellectual Property
All content on this site — text, design, photography, video, audio, the Find Your Gap™ assessment and its scoring, The Gap™, and the Follow Through Method™ — is owned by The Hayes Project or its licensors and is protected by copyright and other laws. We grant you a limited, revocable, non-exclusive licence to view and share the content for personal, non-commercial use with attribution. All other use, including training machine-learning models on our content, requires written permission.
7. User Submissions
If you send us a message, question, testimonial, or other submission, you keep ownership of it and grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display it in connection with our services. Do not submit confidential, clinical, or third-party personal information.
8. Third-Party Links and Retailers
The site links to third-party sites, podcast platforms, and book retailers. We do not control those sites and are not responsible for their content, products, or privacy practices. Your dealings with them are between you and them.
9. Purchases and Payment
Prices are shown in U.S. dollars and may change. Payments are processed by third-party processors, and you agree to their terms. Taxes may apply. Program purchases are governed by the Program Terms, including any automatic renewal and refund provisions.
10. Disclaimers
The site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that any particular outcome will result from using our content or programs. See also our Disclaimer and Earnings Disclaimer.
11. Limitation of Liability
To the fullest extent permitted by law, The Hayes Project and its owners, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the site or our services will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars. Some jurisdictions do not allow these limits, so they may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless The Hayes Project from claims, losses, and expenses (including reasonable legal fees) arising out of your use of the site, your submissions, or your violation of these Terms or any law.
13. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of California without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for thirty days. Any unresolved dispute will be brought exclusively in the state or federal courts located in San Bernardino County, California, and you consent to personal jurisdiction there. Nothing here prevents either party from seeking relief in small claims court.
14. Changes to the Site or These Terms
We may change, suspend, or discontinue any part of the site, and we may update these Terms. Updates take effect when posted with a revised “Last updated” date. Continued use after that constitutes acceptance.
15. Termination
We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the service. Sections on intellectual property, disclaimers, liability, indemnification, and dispute resolution survive termination.
